Public signing of the new Civil Procedure Code of the Republic of Kazakhstan

Nursultan Nazarbayev pointed out that it was the first time when the law was signed in public due to the importance of the document for each and every person of the country. He also said that the presence of media at the ceremony would better convey to the public the nature and value of the new Code.

 “In order to implement five institutional reforms, we need to approve 59 legislation acts. 16 laws have been signed. Today, I will sign the 17th law. For the first time we are doing it publicly, because the document is of great importance for our country, for every citizen of Kazakhstan,” he said.

The President stressed that the new Code will fundamentally improve the legal framework of the country.

“Starting from next year, Kazakhstan will shift from a five-tier to three-tier court system. This will simplify the process of considering cases, improve efficiency and make decisions more understandable to ordinary people. Moreover, there will be introduced a new procedure for consideration of disputes in the field of investment. It will improve the investment attractiveness of the country, strengthening the institution of private property thus ensuring future economic growth,” Nursultan Nazarbayev said.

The new code also extends the possibility of applying information technologies in civil proceedings; for example, in providing copies of records more widely, which will ensure openness in the court system. Moreover, it expands the scope of conciliatory measures of pre-trial dispute settlement.

“In addition, we are expanding the scope of the application of conciliatory measures in pre-trial settlements of disputes. Reconciliation will be implemented not only by mediators but also by judges of the first appellate court and lawyers. The widespread use of reconciliation will reduce the burden on the judicial system, and most importantly, reduce the time needed to resolve disputes,” the Head of the State said.

The new Code contains a lot of other innovations, including reduction in the role of prosecutors in civil dispute trials. In addition, it expands the use of simplified proceedings, improves the jurisdiction of courts, and introduces a retrial under the new circumstances.

In conclusion, Nursultan Nazarbayev congratulated the attendees on signing of the new Code, expressing confidence that its implementation will bring benefits to the people.
